2. Eligibility

To use PartnerMood, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

PartnerMood provides:

• Mood Tracking: Tools to record and track emotional states
• Partner Synchronization: Real-time connection with your partner
• AI Insights: Automated analysis and recommendations
• Analytics: Visualization of mood patterns and trends

5. Acceptable Use

5.1 You May:

• Use the Service for personal, non-commercial purposes
• Connect with one partner at a time
• Export your personal data
• Share feedback and suggestions

5.2 You May NOT:

• Use the Service for illegal purposes
• Violate any laws or regulations
• Harass, abuse, or harm others
• Share false or misleading information
• Attempt to gain unauthorized access to the Service
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems (bots, scrapers) without permission
• Interfere with or disrupt the Service
• Resell or commercially exploit the Service

6. Partner Pairing and Data Sharing

When you pair with a partner:

• You explicitly consent to share your mood data with them
• Your partner can see your current mood and history (as configured)
• Both parties must consent to the pairing
• Either party can end the pairing at any time
• Ending pairing does not delete historical shared data

7. User Content

7.1 Ownership

You retain ownership of:

• Your mood data
• Notes and observations
• Personal information

7.2 License to Use

By using the Service, you grant us a limited license to:

• Store and process your data to provide the Service
• Use aggregated, anonymized data to improve the Service
• Generate AI insights based on your data

8. Intellectual Property

The Service and its content are protected by copyright, trademark, and other laws. This includes:

• PartnerMood name, logo, and branding
• App design, interface, and user experience
• Source code and algorithms
• Documentation and materials

You may not copy, modify, or create derivative works without our written permission.

10. Subscription and Payments

10.1 Free Features

Basic mood tracking and partner sync are currently free during beta.

10.2 Future Premium Features

We may introduce premium features in the future. If so:

• Pricing will be clearly communicated
• Subscriptions may auto-renew unless canceled
• Refunds will be handled per our refund policy
• You can cancel anytime through your account settings

11. Service Availability

We strive for 99.9% uptime, but the Service is provided "as is" and:

• May be temporarily unavailable for maintenance
• May be interrupted by factors beyond our control
• May be modified or discontinued at any time
• Is not guaranteed to be error-free or secure

12. Termination

12.1 By You

You may terminate your account at any time by:

• Using the account deletion feature in settings

12.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• Your account is inactive for extended periods
• We're required by law to do so
• We discontinue the Service

12.3 Effect of Termination

• Your data will be deleted within 30 days
• Partner connections will be severed
• You lose access to the Service immediately
• These Terms survive termination where applicable

13. Disclaimers and Limitations

13.2 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness
• Uninterrupted or error-free operation
• Security or freedom from viruses

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us (if any) in the past 12 months
• We are not responsible for damages resulting from your use or inability to use the Service
• We are not liable for actions taken based on AI insights

15. Indemnification

You agree to indemnify and hold harmless PartnerMood from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Your content or data

16. Dispute Resolution

16.1 Informal Resolution

Before filing a legal claim, please contact us at Partnermood@partnermood.app to resolve the issue informally.

16.2 Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.

16.3 Arbitration

Any disputes will be resolved through binding arbitration, except:

• Small claims court matters
• Intellectual property disputes
• Cases where arbitration is prohibited by law

17. Changes to Terms

We may modify these Terms at any time. We will:

• Notify you of significant changes via email or in-app notification
• Update the "Last Updated" date
• Give you 30 days to accept new terms

Continued use after changes constitutes acceptance of new terms.
