1. Agreement to Terms

By downloading, accessing, or using the Partner Mood application (“App”) or website (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Mood AI s.r.o. (“Company,” “we,” “us,” or “our”).

2. Description of Service

Partner Mood is a relationship wellness application that allows couples to:

Track and share daily mood entries
View AI-generated insights and predictions
Access compatibility analytics
Receive smart nudges and reminders

The Service is designed as a wellness and communication tool only.

PARTNER MOOD IS NOT A SUBSTITUTE FOR PROFESSIONAL THERAPY, COUNSELING, OR MEDICAL ADVICE.

By using this Service, you acknowledge and agree that:

The App is a wellness tool, not a medical or therapeutic service
AI-generated insights are for informational purposes only and should not be relied upon as professional advice
We do not provide diagnosis, treatment, or professional counseling
The App does not create a therapist-patient or doctor-patient relationship
If you are experiencing serious relationship issues, mental health concerns, or emotional crises, you should seek help from a licensed professional

We expressly disclaim any liability for decisions made or actions taken based on information provided by the Service.

4. Eligibility

To use the Service, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet these requirements.

5. Account Registration

5.1 Account Creation

To use certain features, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

5.2 Partner Pairing

The Service allows you to connect with a partner using a unique pairing code. By pairing:

You consent to share your mood data with your connected partner
You acknowledge that your partner will see your mood entries and shared insights
You can disconnect (unpair) at any time through the App settings

We are not responsible for any consequences arising from sharing data with your partner.

6. Subscription and Payments

6.1 Pricing

The App offers free features and premium subscription plans
Current pricing is displayed in the App and on our website
Prices are subject to change with reasonable notice

6.2 Billing

Subscriptions are billed through Apple App Store or Google Play Store
Payment processing is handled entirely by the respective app store
We do not store or process your payment information

6.3 Cancellation

You may cancel your subscription at any time through your app store account settings
Cancellation takes effect at the end of the current billing period
You retain access to premium features until the end of the paid period

6.4 Refund Policy

All purchases are final. We do not offer refunds.

Refund requests must be directed to the respective app store (Apple or Google) according to their refund policies. We have no control over and are not responsible for app store refund decisions.

7. Acceptable Use

You agree NOT to:

Use the Service for any illegal purpose
Impersonate another person or entity
Share your account credentials with others
Attempt to reverse engineer, hack, or compromise the Service
Use the Service to harass, abuse, or harm others
Upload malicious code or interfere with the Service’s operation
Use automated systems or bots to access the Service
Violate any applicable laws or regulations

We reserve the right to terminate accounts that violate these Terms.

8. User Content

8.1 Your Content

You retain ownership of the content you submit (mood entries, notes, etc.). By submitting content, you grant us a limited license to:

Store and process your content to provide the Service
Generate anonymized, aggregated analytics
Improve our AI models using anonymized data

8.2 Content Restrictions

You agree not to submit content that is:

Illegal, harmful, or offensive
Infringing on third-party rights
Malicious or technically harmful

9. Intellectual Property

9.1 Our Property

The Service, including its design, features, code, AI models, and content (excluding user content), is owned by Mood AI s.r.o. and protected by intellectual property laws.

You may not:

Copy, modify, or distribute our content
Use our trademarks without permission
Create derivative works based on the Service

9.2 Feedback

If you provide feedback or suggestions, you grant us the right to use them without compensation or attribution.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

Merchantability and fitness for a particular purpose
Accuracy, reliability, or completeness of AI-generated insights
Uninterrupted or error-free operation
Security of data transmission
Results or outcomes from using the Service

We use reasonable efforts to provide a reliable service, but we do not guarantee that the Service will meet your expectations or requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOOD AI S.R.O. SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Damages arising from your use of or inability to use the Service
Damages arising from decisions made based on AI-generated insights
Damages arising from your relationship with your partner
Any amount exceeding the fees paid by you in the 12 months preceding the claim

This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mood AI s.r.o., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your relationship decisions or actions

13. Service Modifications and Termination

13.1 Service Changes

We reserve the right to:

Modify, suspend, or discontinue any part of the Service
Change features, pricing, or availability
Limit certain features or restrict access

We will use reasonable efforts to provide notice of significant changes.

13.2 Account Termination

We may terminate or suspend your account at our discretion if:

Your use poses a security risk
We are required to do so by law
We discontinue the Service

13.3 Effect of Termination

Upon termination:

Your right to use the Service ceases immediately

Provisions that should survive termination will remain in effect

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by:

Posting updated Terms in the App
Updating the “Last Updated” date
Notifying you via email for material changes

Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
